Founded in 2020 by a team of multidisciplinary professors from Ottawa University and Université du Québec à Montréal, the basis for the development of the Clinic stems from current research in Canada and elsewhere demonstrating an important increase in the adjudication of people living with mental health issues and in conditions of homelessness. This population must also deal with multiple legal proceedings in other legal fields such as housing, work and youth protection. In addition, research conducted through community organizations, universities as well and the public sector has shed light on the important difficulties of having the rights of individuals respected and applied in the judicial process. The Clinic will use working methods which have proven to provide practical and needs-based solutions to the issues faced by marginalized groups, including accompaniment and interdisciplinary team work.

Fondé en 2020 par une équipe multidisciplinaire de professeur·es de l'Université d'Ottawa et de l'Université du Québec en Outaouais, le projet de la clinique découle de résultats de recherches montrant la croissance de la judiciarisation des personnes vivant des troubles de santé mentale et/ou en situation d’itinérance. Ces personnes font l’objet de diverses mesures et procédures, souvent complexes, dans des domaines de droit tels que l’intégrité de la personne, le droit pénal, le logement, le travail, la protection de la jeunesse où elles font face à d’importantes difficultés de mise en œuvre et de respect de leurs droits. En parallèle, les services juridiques sont peu accessibles, ce qui complique la défense des droits et contribue à rendre les démarches anxiogènes et pénibles. Or l’accompagnement des personnes dans ces démarches peut permettre de faire valoir leur point de vue, de défendre leurs droits, tout en diminuant leur anxiété et en favorisant le rétablissement.
